David Whelan -v- Quarriers and John Porteous
As you know, your client was examined by Dr Janet Boakes, consultant psychiatrist on 23rd October 2006. We understand that during the meeting your client requested a copy of Dr Boakes' notes and of her completed report. He reiterated the request in his letter of 24th October 2006, copied to ourselves.
We should be obliged if you would impress upon your client the requirement not to enter into direct communication with either ourselves or the medical expert instructed on our behalf. Further, we should be obliged if you would confirm that no further steps be taken by or on behalf of your client to recover Dr Boakes' report or notes. Any such attempt will of course be
opposed. The documents concerned are privileged in terms of the Data Protection
Act 1998 schedule 7 (10).
